Negotiation is a widely used form of Alternative Dispute Resolution (ADR) that involves two or more parties engaging in a structured conversation to reach a mutually beneficial agreement. When people want to find a solution to a disagreement, negotiation is often the first step they take. In some circumstances, disagreements may be resolved if both sides are willing to lay their cards on the table and make an effort to reach a compromise via negotiation. If it is necessary, professionals in conflict resolution are able to accept orders and conduct negotiations on behalf of the parties involved. Negotiation is considered a less formal, more private process than other forms of ADR, such as mediation or arbitration. The first step in the ADR process, parties seek to resolve disputes early and avoid the time, expense, and uncertainty of litigation. During a negotiation, each party presents their perspective on the dispute, explores potential solutions, and works to find common ground. The success of a negotiation depends on the skill of the negotiators, the willingness of parties to approach the negotiation in good faith, and the nature of the dispute itself.
