Mens rea MEANING
What exactly does it mean to have Mens rea? The concept of having a "guilty mind," often known as the intent component of a crime. An accurate translation of the phrase would be "criminal purpose," which refers to the intention to carry out an action that is deemed illegal by legislation or the common law. Intent, recklessness, and negligence are the primary subtypes of the mens rea legal concept. When the mens rea and actus reus do not coincide in time, there is potential for problems to occur. In some circumstances, the "mens rea" legal standard might be "transferred" from the "intended victim" to the "unintended victim" according to the legal principle known as "transferred malice." Mens rea refers to a mental component, while actus reus refers to a physical component. This distinction is what distinguishes mens rea from actus reus. In the majority of cases, the mens rea comes before the actus reus since the individual committing the crime should have some kind of purpose or awareness about the consequences of their acts.
