In legal terms, a judgment refers to a formal decision or ruling made by a court of law. It is the final outcome of a legal dispute or lawsuit, effectively determining the rights and obligations of the parties involved. A judgment is typically provided by a judge or a jury after considering all the evidence and arguments presented during the legal proceedings. It sets forth the court's legal reasoning and conclusions, which may include findings of fact, determinations of liability or innocence, and orders for remedies or damages. A judgment holds significant weight and serves as a binding directive that both parties must adhere to. It represents the culmination of the legal process and plays a crucial role in providing closure, justice, and a sense of finality to the parties involved. In In order for a creditor to successfully recover a debt from a debtor, the creditor must first get a judgement in their favour.
Format of the judgement
Th judgment will be passed down from the court and is reported. The judgment will contain the following:
The chronology of the proceedings is included in the judgement;
In addition to that, it includes a presentation of questions that need to be addressed;
The set of rules and/or principles of law that are pertinent to the situation;
The process of applying the law to the existing circumstances;
The conclusion reached or the decision; and
The action taken or the directive that will be taken in order to put the court's ruling into effect.
