in rem meaning
A right in rem is a right that may be exercised against the whole world, and rights that are established as proprietary rights fall under this category. This indicates that whether something is a right in rem or a propriety right, it will bind any future owner of the property it pertains to. In contrast, if the right is a licence – which, similar to a permission, is a right in personam, which indicates that it is a right that can only be exercised with the person who granted it – it is an interest that is only protected against certain individuals. This is because a right in personam can only be exercised with the person who granted it. This indicates that in the event that the property is sold, your rights cannot be enforced against the new buyer of that land.
