Employment Law Tutor

Employment Law Tutor is intended mainly for undergraduate and graduate students of Employment Law and Practice. Many significant issues of individual employment law are covered. In addition to common law and legislation, employment law in the United Kingdom is derived from codes of practise and European Union (EU) law. In recent years, EU law has had a particularly substantial impact, both in terms of legislation and Court of Justice decisions (ECJ).

The Industrial Relations Act of 1971 aimed to provide, for the first time, a complete regulatory framework for all areas of employment law, from collective bargaining to individual rights. Previous to this, employment disputes were resolved in courts of common law under the common law. There were no unique measures or safeguards. There were no notions of justice; an employer was permitted to terminate an employee as long as it did so in accordance with the terms of the contract. The 1971 Act established the ability to file a complaint for "unfair" termination. The bulk of individual rights were first consolidated in the Employment Protection (Consolidation) Act of 1978 (EP(C)A 1978) and then again in the Employment Rights Act of 1996 (ERA 1996). The Employment Relations Acts of 1999 and 2004 (ERA 1999 and 2004), the Employment Act of 2002 (EA 2002), and the Work and Family Act of 2006 revised the 1996 Act.

The Trade Union and Labour Relations (Consolidation) Act of 1992 (TULR(C)A 1992), as revised by the Trade Union Reform and Employment Rights Act of 1993 and the Employment Rights Act of 1999, integrated all statutory laws pertaining to trade unions and groups. The Equal Pay Act of 1970 (EPA 1970), the Sex Discrimination Act of 1975 (SDA 1975), the Race Relations Act of 1976 (RRA 1976), and the Disability Discrimination Act of 1995 (DDA 1995) were all abolished and replaced by the Equality Act of 2010.
