Declaring Criminal Convictions to Your Employer

With the implementation of Police, Crime, Sentencing and Courts Act 2022, people are still compelled to disclose their criminal records to their employers, but now for a shorter length of time. On October 28, 2023, Section 193 of the Police, Crime, Sentencing and Courts Act 2022 became operative and came into force. It modifies declaring custodial convictions to your employer in the following ways:

Note that the time frames mentioned above apply to offenders who were older than 18 at the time of conviction. Where the perpetrator was under the age of 18 at the time of conviction, the mandatory disclosure period is modified, although somewhat reduced.

Employers are responsible for ensuring that all relevant systems and paperwork are updated to account for the new time frames. Roles requiring basic or advanced DBS checks won't be impacted by these changes.
