affirmed Meaning
In the context of the law, the term "affirmed" may have a few different meanings that are all linked to one another, but in general it means "to confirm or ratify." This term appears in many different contexts, such as the following: The Court of Appeal affirmed and upheld the decision that was the subject of the appeal. Indicates that a court has agreed with the decision of a lower court in respect of the same case.
For example in R v Savage; Parmenter [1992] 1 AC 699 Lord Diplock in the House of Lords reaffirmed the interpretation of maliciously as laid down R v Mowatt [1968] 1QB 421:
“It is quite unnecessary that the accused should have foreseen that his unlawful act might cause physical harm of the gravity described in the section, i.e. a wound or serious physical injury. It is enough that he [foresaw] ... that some physical harm to some person, albeit of a minor character, might result.”
When the court AFFIRMs
When the court affirms, it means that the decision made by the lower court is upheld. This can happen when a party appeals a ruling they disagree with, and the appellate court decides that the ruling was correct. Affirming a decision means that it becomes final and binding, and the parties are expected to comply with it. However, the court may affirm a decision without endorsing all of the reasoning behind it. In such cases, the court may only agree with the outcome, but not with the legal analysis or reasoning that led to it.
