Ratio decidendi


Ratio decidendi MEANING

The term "ratio decidendi" literally translates to "the reason for deciding," and it is a component of the judgement that is handed down at the conclusion of a legal proceeding. In order to reach a decision about the outcome of a case, a judge must first examine the evidence presented and then apply the applicable legal rule or principle. That part of a judgement which forms the basis for the decision. The opposite of obiter dictum.
