Crown Court meaning

The Crown Court deals with all crime committed for trial by Magistrates Courts. Cases for trial are heard before a judge and jury. The Crown Court also acts as an appeal Court for cases heard and dealt with by the Magistrates. The Crown Court can also deal with some civil and family matters. The following categories of legal disputes are within the Crown Court's purview to decide upon:

(a) Crimes that can only be prosecuted by indictment; the Crown Court is the appropriate venue for dealing with cases of this kind.

(b) Regardless of whether the magistrates accept jurisdiction or not, cases in which the defendant enters a not guilty plea will be transferred to the Crown Court for trial regardless of whether the magistrates refuse to exercise their authority or the defendant chooses to have his or her case heard in the higher court.

(c) Either way offences where the defendant pleads guilty – a defendant who has appeared before the magistrates and entered a guilty plea to an either way offence at the plea before venue hearing will be committed to the Crown Court for sentence if the magistrates believe that their sentencing powers are inadequate.

(d) Appeals from the magistrates' court A defendant who wishes to appeal against his conviction and/or sentence imposed by the magistrates' court for an either way or summary only offence has a right of appeal to the Crown Court. This right of appeal can only be exercised if the magistrates' court sentenced the defendant for an offence that was either either way or summary only.

Crown court and the Old Bailey

The Crown Court and the Old Bailey are two legal entities that deal with criminal cases. Crown Court is responsible for hearing serious criminal cases, including drug offenses, rape, and murder. The court consists of a judge and a jury of 12 people who decide whether the defendant is guilty or not guilty. The Old Bailey, on the other hand, is a branch of the Crown Court, where the most serious criminal cases are heard.
